Terms and Conditions of Esso Hong Kong Facebook Page Contests

Eligibility

1. Entrants of the contest(s) (each a “Contest”) on the Esso Hong Kong Facebook Page (“Facebook Page”) must be Hong Kong permanent residents aged 18 and above and residing in Hong Kong. ExxonMobil Hong Kong Limited (“EMHK”) has appointed its advertising agency to administrate this Facebook page. The staff of the retail sales division of EMHK and EMHK's appointed advertising agency, Esso service station dealers/operators and station staff are not eligible to participate in the Contests.

Contest Period

2. The Contest period is as stipulated in the Contest-specific post on the Facebook Page (each a "Contest Post").

Mechanics

3. Entrants must 'Like' the Facebook Page and the Contest Post, and must submit their entries by posting a comment to the Contest Post. Entries must be relevant to the Contest question posted in the Contest Post, and must be submitted within the Contest period stipulated in the Contest Post. No fuel or convenience store purchase is required.
4. By submitting comments to the Contest Post, entrants are deemed to have confirmed that their submitted comments are their original creation, no copying or infringing any third party's interests is involved and that they shall be fully responsible for all claims made by any person whomsoever in respect of all losses and damages arising from any breach, and shall indemnify and keep EMHK fully indemnified against all liability and losses which EMHK may sustain or incur arising therefrom. Entrants acknowledge that they will be fully responsible for the risks and costs associated with their participation in the Contest. EMHK reserves the right to disqualify any entrants if the submitted comments are infringing any third party's rights or interests.
5. Upon submission of comments to the Contest Post, entrants are deemed to have granted EMHK, its affiliates, community partners and/or appointed advertising agencies the right to use the contents of all submitted comments without the prior consent of such entrants and without any compensation. Such right includes without limitation the use, publication, making copies and editing of the contents of comments for the purposes of marketing, advertising or promotion activities or internal communications of EMHK, its affiliates, community partners and/or appointed advertising agencies, or for such other uses as EMHK, its affiliates, community partners and/or appointed advertising agencies reasonably deem fit.
6. Each entrant can only submit one (1) comment for each Contest Post for the purposes of each Contest. In the event multiple comments to the same Contest Post are submitted by an entrant, EMHK may at its sole discretion select any one (1) comment submitted by the particular entrant as the comment submitted by such entrant.
7. If the comment submitted by the entrant is in breach of the Page User Code, EMHK reserves the right to delete such comment and the entrant will be disqualified.

Winners and Results

8. The winner(s) will be selected based on the judging criteria stipulated in the Contest Post at EMHK's sole discretion.
9. In the event of any participation via fraudulent account or any other illegal channels, or any use of any programme to interrupt or control the Contest by an entrant, such entrant will be disqualified without prior notice.
10. The winner(s) will be notified via a winner(s)' announcement posted in a comment to the Contest Post.
11. The winner must use his/her Instagram account which has won the Contest to submit his/her personal information which may include name, Esso Smiles card number, phone number, address and email address by replying to the Instagram private message sent by EMHK within the stipulated period for the purpose of prize fulfilment. Prize(s) will be forfeited if any winner fails to provide his/her personal information within the stipulated period, and EMHK reserves the right to select an alternative winner.
12. EMHK and its appointed advertising agency accept no responsibility for any unsuccessful or late submissions of comment to any Contest Post whether due to technical reasons or otherwise. Proof of comment submission is not proof of receipt of a comment to such Contest Post by EMHK and its appointed advertising agency. Comments submitted by any other means other than through the Contest Post on the Facebook Page will not qualify for the Contest.
13. The prize(s) for the Contest(s) will be stated in the Contest Post(s). All prizes are non-transferable and cannot be exchanged for cash.
14. EMHK will send a Facebook private message to the winner(s) and provide the prize fulfillment details. Winners are required to collect the prize(s) within specified prize fulfillment date(s) at designated service station(s) or through local registered post. Prize(s) in the form of Esso Smiles points will be credited to the winner's Esso Smiles account within 14 days after the provision of Esso Smiles card number by the winner. Prize(s) will be forfeited for any late collection.
15. EMHK reserves the right to substitute any prize with a prize of equivalent or greater value at its sole discretion without prior notice.

Others

16. By submitting a comment to the Contest Post, each entrant is deemed to have accepted these Terms and Conditions, and agreed to be bound by them. EMHK and its appointed advertising agency reserve the right to disqualify any entrant from participating in the Contest and/or prize fulfillment in the event of any violation of these Terms and Conditions.
17. EMHK and its appointed advertising agency are not responsible or liable for any claim, loss or damage whatsoever arising out of or in connection with the Contests or the prizes awarded during the Contests.
18. The Contests are in no way sponsored, endorsed or administered by, or associated with, Facebook. In using Facebook, each user acknowledges that he/she must comply with Facebook's Terms of Service and Pages Terms.
19. EMHK is entitled to cancel or vary the whole or part of the Contest and modify these Terms and Conditions without prior notice. In case of any dispute, the decision of EMHK shall be final and conclusive.
20. In the event of inconsistencies between the English and Chinese versions of these Terms and Conditions, the English shall prevail.

Personal Information Collection Statement

21. The personal information provided by participants in connection with the Contests will only be used for the purpose of the Contests, including notification of results, prize arrangement and prize fulfillment. All collected personal information will be destroyed after completion of prize fulfillment.
22. The provision of personal information by entrants is voluntary, however failure to provide the required information may result in disqualification from participating in the Contests and/or prize fulfillment (if applicable).
23. Each entrant has the right to request access to his/her personal information held by EMHK and to request correction of any inaccurate personal information.
